Terms and Conditions

These Terms and Conditions apply to the company “Independent Event GmbH,” hereinafter referred to as “Independent Event.” Any opposing terms and conditions are hereby rejected. Oral agreements and assurances require written confirmation. Gender-specific synonyms used in these Terms and Conditions apply equally to both female and male forms. As a customer in these Terms and Conditions, all customers of Independent Event are considered. Independent Event as the “contractor” or “client” refers to all business relationships with customers, suppliers, or other clients or contractors. A visitor refers to any guest at an Independent Event event.

Cancellation / Program Changes

In the event of a government-mandated cancellation of the event (for example, due to the coronavirus), purchased tickets can be returned up to two months after the event date (with a refund of the costs). Last-minute program or schedule changes are at the discretion of the organizer and do not entitle the ticket holder to a refund. In the case of the cancellation of one or more artists, non-use of parts of the venue, or temporary technical failure due to force majeure, there is no entitlement to a price reduction. Costs incurred (such as travel, accommodation, processing fees, etc.) will not be reimbursed by the organizer in the case of an unavoidable cancellation, rescheduling, or program or lineup change.

Rights to Image / Sound

The contractual partner agrees that stands, equipment, staff, or similar may be photographed and filmed. It is agreed that these materials may be stored, distributed, and used without restriction, both analog and digital. The publication of photos/videos on the internet, in magazines, or other media does not entitle the creator of the image/video or the organizer to any claims.

Independent Event GmbH is permitted to use photos, videos, or audio recordings for advertising and reporting purposes. Independent Event GmbH may pass on all recordings to third parties for publication. There is a waiver of the right to be named as the creator of the recordings. Independent Event GmbH strives to credit the creator when feasible, but the decision rests solely with the publishing entity.

Austrian law exclusively applies, and the court of jurisdiction is Salzburg City.

If images, photos, or videos are transmitted to Shutdown Festival or published on the internet, Independent Event is granted the right to publish and distribute them to third parties for publication. The creator explicitly waives the right to be named. All recordings, whether photos, videos, or audio, must be clearly labeled as recordings of Shutdown Festival when published.

Regarding videos, especially those uploaded to the YouTube platform, it is prohibited to use phrases such as “official” or “official Aftermovie” or terms that suggest the video is an official Shutdown Festival video.

Quantity / Amount of Ordered Goods

It is agreed that the quantity or amount of ordered goods refers exclusively to the written offer mentioned. Any changes to the requirements must be explicitly made in writing. No claims can be made against Independent Event based on orders placed by a third party.

Delivery / Unloading

Independent Event will not provide assistance for delivery or unloading, including equipment or personnel. No forklift or other vehicles or equipment will be provided for proper unloading unless otherwise agreed in writing.

Hospitality

No free meals, accommodation, or transportation to and from the event will be provided to the contractor. The contractor is responsible for arranging the necessary transportation. Independent Event will not provide lounge areas, offices, or similar facilities for the contractor or staff unless otherwise agreed in writing.

Loading

Delivery may only be unloaded at the authorized location after authorization. The authorized person will be announced at the fulfillment location. If delivery is made to an unauthorized place or without prior agreement, it is the contractor’s responsibility and at their own cost to unload at the correct location. Any costs incurred by Independent Event as a result will be charged to the contractor, along with a processing fee. Delivery may only be taken away with the approval of an authorized person and after joint inspection of the goods, along with a signed handover protocol. Any defects not identified in the protocol are considered as present at the time of handover. If delivery is taken away without an authorized person or no handover protocol is filled out, it will be assumed that any damage or defects were already present before or at the time of delivery.

Damages

Independent Event assumes no liability for any items of the contractor or those used by the contractor. This explicitly excludes theft, loss, or damage to other items. The contractor is liable for all damage to movable or immovable property, including damage to asphalt, floors, the environment, or persons. The contractor is fully liable for all employees or assistants, even if negligence caused the damage. Independent Event assumes no liability to suppliers, except in cases of gross negligence or intentional damage, with a maximum liability of €2,000. Any damage should be immediately reported to an authorized person upon discovery.

Payment Terms

The payment term stated in the contract is the only valid term. Any deviations must be explicitly agreed upon in writing.

Benefits Through Third Parties

If the supplier is recommended or introduced by a third party, and the supplier or third party gains an undue benefit, the supplier is not entitled to any direct or indirect payment.

Storage of Equipment / Stay

The contractor must remove all items and equipment from the event site after the event. If items or equipment are left at or near the fulfillment site, they must be removed at the contractor’s expense, plus a processing fee.

Employee Registration / Eligibility / Labor Law

The contractor must legally register all employees according to current Austrian law. All employees must be paid according to Austrian minimum wage laws. A copy of the social security registration (document A1 or E101) must be sent to jobs@revolutionevent.com before work begins, and a hard copy must be provided at the site before starting work. Only employees with the required qualifications (e.g., driver’s license) may be employed. All Austrian labor law provisions must be adhered to.

Independent Event as Client

Liability for Damages

Each contractor is liable for any damage caused by themselves, their employees, or assistants. If the damage occurs to property owned by Independent Event, a bill will be issued for the cost of the damage to the person or company responsible.

Stage

The organizer ensures that an appropriate stage will be available unless otherwise agreed.

Authorities, Permits

The organizer ensures compliance with all legal requirements and government regulations for the event.

Rental Offer, Contract Conclusion

Our offer is non-binding unless explicitly stated otherwise. The contractual relationship becomes legally binding only upon written confirmation or the start of execution or work. Independent Event reserves the right to reject incoming orders, without providing reasons. If Independent Event is prevented from timely delivery due to no fault of its own, it is relieved of the delivery obligation. Orders directed to Independent Event or orders from the client, without a corresponding written offer, require the contractor’s order confirmation to form a valid contract.
